1. Acceptance of Terms

By downloading, installing, or using GlucoHab ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

GlucoHab is operated by Barry King ("we", "us", or "our"). These Terms constitute a legally binding agreement between you and us.

2. Description of Service

GlucoHab is a mobile application for iOS that helps users:

• Track daily habits and behaviors
• Sync health data from Apple Health (including glucose, steps, sleep, and workouts)
• View personalized insights about correlations between habits and glucose levels
• Run 7-day experiments to test specific habit changes
• Export health data

3. Medical Disclaimer

• Consult Healthcare Providers: Always consult your doctor, endocrinologist, or diabetes care team before making any changes to your diabetes management, medication, diet, or exercise routine.
• Not FDA Approved: GlucoHab is not FDA-cleared or approved for any medical purpose.
• Informational Only: Insights and correlations shown in the App are for educational and informational purposes only. They are not clinical recommendations.
• Emergency Situations: Do not use the App for medical emergencies. If you experience severe hypoglycemia or hyperglycemia, follow your healthcare provider's emergency protocols and seek immediate medical attention.

4. User Responsibilities

By using GlucoHab, you agree to:

• Provide accurate information when tracking habits and health data
• Keep your device secure and protect your account information
• Use the App in compliance with all applicable laws and regulations
• Not attempt to reverse engineer, decompile, or hack the App
• Not use the App for any unlawful or prohibited purpose
• Not share, sell, or redistribute App content or features

5. Subscriptions and Payments

Free Version

GlucoHab offers a free version with basic habit tracking and limited insights.

Pro Subscription

The Pro subscription unlocks unlimited habits, all correlation insights, guided 7-day experiments, and weekly summaries. Subscription details:

• Subscriptions are billed through the Apple App Store
• Payment is charged to your Apple ID account at purchase confirmation
• Subscriptions auto-renew unless canceled at least 24 hours before the current period ends
• You can manage or cancel subscriptions in your Apple ID Account Settings
• No refunds for partial subscription periods
• Pricing may vary by region and is shown in the App before purchase

Free Trial

If offered, free trials automatically convert to paid subscriptions unless canceled before the trial period ends. You can cancel anytime during the trial without charge.

6. Data Privacy and Security

Your privacy is paramount. Key points:

• Local Storage: All health data and habit tracking information is stored locally on your iOS device using a SQLite database.
• No Cloud Sync: We do not transmit or store your health data on any external servers or cloud services.
• Apple Health Integration: The App reads (but never writes) health data from Apple Health with your explicit permission. This data remains in Apple Health and on your device.
• Third-Party Processors: We use RevenueCat for subscription management. They receive your App Store purchase information but NOT your health data.

7. Intellectual Property

The App, including its design, code, algorithms, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from the App.

8. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of any data or insights
• Uninterrupted or error-free operation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Health complications or medical issues
• Data loss or corruption
• Loss of profits or business interruption
• Reliance on App insights or recommendations

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless GlucoHab, Barry King, and our affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or violation of any rights of another party.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time by uninstalling it from your device. Upon termination, all licenses and rights granted to you will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email (if provided). Your continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.

13. Apple App Store Terms

By using GlucoHab through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide support or maintenance for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
